Terms of Use — DFS Gate

1. Agreement to These Terms

By accessing or using the DFS Gate website at dfsgate.com or any related services (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Service.

These Terms apply to all members of a DFS Gate pool, including pool administrators ("admins") and regular participants ("members").

2. What DFS Gate Is

DFS Gate is a private pool management tool. It helps a group of people:

Coordinate entry into a free, private FanDuel DFS contest
Track who has paid their share of the group pot
Automatically distribute FanDuel contest invite links after payment is confirmed
Display standings and results for the group

        DFS Gate does not operate a gambling platform, process payments, or hold
        funds. The underlying DFS contest is a free private contest on FanDuel.
        All money moves directly between participants via Venmo (peer-to-peer). DFS Gate
        only confirms that a payment occurred by reading a Venmo notification email.
      

DFS Gate is not affiliated with, endorsed by, or sponsored by FanDuel, DraftKings, Venmo, or PayPal.

3. Eligibility

To use the Service you must:

Be at least 18 years of age
Have a valid Venmo account in good standing
Have a valid FanDuel account if you wish to participate in the underlying contest
Be invited to a pool by an authorized pool admin

By using the Service you represent and warrant that you meet all of the above requirements.

4. Pool Entry and Payments

Each pool has an entry fee set by the admin. To secure your spot in a pool you must pay the entry fee to the admin via Venmo using the payment link provided to you, which pre-fills the correct amount and memo code.

Your obligation to pay runs to the admin, not to DFS Gate. DFS Gate facilitates confirmation of payment but is not a party to the financial transaction.
No refunds. Once a payment is confirmed and your FanDuel contest invite link has been sent, your entry fee is non-refundable. If a game is cancelled or a pool is disbanded before the contest invite is sent, refund decisions are at the sole discretion of the pool admin.
Payment disputes are between you and the admin. DFS Gate has no authority to compel payment or issue refunds. If you have a dispute about a payment, resolve it directly with your pool admin.
Payouts are handled by the admin. DFS Gate does not distribute winnings. The pool admin is solely responsible for paying out the winner(s) via Venmo or any other method they choose.

5. Pool Administration

Pool admins are responsible for:

Setting up the free private FanDuel contest and providing the correct invite URL
Setting a fair entry fee and communicating the payout structure to members
Confirming or manually overriding payment status when needed
Distributing winnings to the winner(s) promptly after results are finalized
Ensuring all participants meet the eligibility requirements above

DFS Gate provides tools to help admins do these things but does not supervise or guarantee admin conduct.

6. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable law or regulation
Attempt to access another member's account or portal link
Submit false payment information or manipulate memo codes to gain unauthorized contest access
Reverse engineer, scrape, or interfere with the Service's infrastructure
Use the Service to run pools open to the general public in a manner that constitutes unlicensed gambling under applicable law

DFS Gate is intended for use among a closed, pre-existing group (friends, colleagues, or a private league). It is not designed or licensed for commercial gambling operations.

7. Intellectual Property

All content on the Service — including the DFS Gate name, logo, design, and software — is owned by or licensed to DFS Gate and may not be copied, reproduced, or distributed without our written permission. Nothing in these Terms grants you any ownership rights in the Service.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE MAKE NO WARRANTY REGARDING THE ACCURACY OF CONTEST RESULTS OR STANDINGS, WHICH ARE SOURCED FROM FANDUEL AND SUBJECT TO FANDUEL'S OWN TERMS.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DFS GATE AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST POOL WINNINGS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED ZERO DOLLARS, AS DFS GATE DOES NOT RECEIVE ANY FEES FROM MEMBERS DIRECTLY.

10. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and notify active members by email. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the United States and the state in which the pool admin resides, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be resolved through good-faith negotiation between the parties before resorting to formal legal proceedings.
